H-1B Work Visa

H-1B work visas are granted to foreign nationals who look forward to work in the United States. In certain circumstances, US employers look forward to employ foreign nationals and such foreign nationals may not be able to work in America without legal permission. This H-1B non-immigrant visa allows US employers to hire foreign nationals. However, a foreign national will be granted this temporary visa only is he is eligible to work in the United States and this is a temporary visa that does not confer lawful status.

A foreign worker may work for a US employer for around six years with an H-1B visa. H-1B visa application process is easier and faster and the USCIS will adjudicate an H-1B visa application within 15 days from the date of application. This will help the US employers to quickly hire workers. The US employer who looks forward to hire a foreign national must file an application for an H-1B visa and the foreign worker may not be able to file an application for this visa. Nevertheless, US employers may hire foreign nationals only if they prove that they are not able to find suitable US citizens, to fill the vacant positions.

There is also a numerical limit on the number of H-1B visas that are granted every year and according to the US immigration laws, only 85,000 H-1B visas will be granted every year. This includes, 65,000 visas granted to foreign workers and 20,000 visas issued to foreign nationals who complete their advanced degrees in America. USCIS may not accept visa applications after the H-1B visa cap is reached. People who already hold H-1B visas may not be subject to numerical limitations and may extend those visas and remain in the United States for around six years.

To become eligible for an H-1B visa, you need to hold a Bachelor’s or a Master’s degree and must have the relevant work experience for 12 years. If you are eligible, you will initially be granted an H-1B visa for three years. This H-1B visa has lots of advantages and you may apply for a US Green Card while in the United States on an H-1B visa. Similarly, foreign workers who hold H-1B visas, may also bring their family members, such as their spouses and children, along with them to the United States. The dependents may study and obtain driver’s licenses, but they may not work in the United States.
